ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND

MINUTES OF MEETNG

Tuesday, February 2, 2016

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES
 

The minutes of the Animal Matters Hearing Board for January 19, 2016 were approved and adopted. 

 

            Citation No. 6530 – issued to James V. Gross, Sr., for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations.  Mr. Gross was present at the hearing, and not represented by counsel. Testimony was heard from Officer Budd and Mr. Gross. Mr. Gross admitted to being in violation for all three Sections of the Charles County Animal Regulations.

            A motion was made to find Mr. Gross in violation of the all three Sections of the Charles County Animal Regulations with a fine of $160.00 to be paid by March 1, 2016. The vote passed unanimously.

 

Citation No. 6415– issued to Heather A. Townshed, for the alleged violation of Section 230.10.A, and Section 230.12, of the Charles County Animal Regulations for her dog “Red.”  Ms. Townshed was present at the hearing and not represented by counsel. Testimony was heard from Jeff Thomas and Ms. Townshed.  Ms. Townshed admitted to being in violation of all three Sections of the Charles County Animal Regulations.

Based on the testimony heard, a unanimous vote passed to find Ms. Townshed in violation of Section 230.10.A and Section 230.12 was made with a fine of $55.00 to be paid by March 1, 2016, as long as she provides proof of a current animal license to the Office of the County Attorney before March 1, 2016.

 

 

Citation No. 6497 - issued to Lacy Bell, for the alleged violation of Section 230.10.A, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for his dog Twin. Mr. Bell was present at the hearing and not represented by counsel. Testimony was heard from Officer Kevin Earle, Mr. Bell, and Phil Thompson (witness for the County). Entered into evidence were six photos and a vet report, marked County No. 1. Officer Earle stated that he was dispatched to Paws Animal Hospital to take a report for a dog bite.  Officer Earle spoke to Mr. Thompson upon arrival and he explained that Mr. Bell’s dog, Twin had attacked Mr. Thompson’s  miniature schnauzer, “Max”.

Based on the testimony heard, and evidence presented, a motion was made to find Mr. Bell in violation of Section 230.10.A, Section 230.9.A and Section 230.12.5 and ordered to comply with the requirements stated in Section 230.12.5.E, 1,2,3,4,5 (a) and (b), 6, 7 and 8 of the Animal Control Regulations and pay a fine of $250.00 by April 16, 2016. The vote to support the motion was unanimous.

 

Citation No. 6545 – issued to Maurice J. Craney, for the alleged violation of Section 230.12.5 of the Charles County Animal Regulations for his dog Meech. Mr. Craney was present at the hearing and not represented by counsel. Testimony was heard from Officer Budd, Mr. Craney and Ms. Stark (witness for County). Officer Budd stated that she was not present for the attack but had been called out after the attack. Ms. Stark’s yorkie (Pink) was killed by Mr. Craney’s dog, (Meech).  Entered into evidence were eight photos marked County No. 1.

Based on the testimony heard, and evidence presented, a motion was made to find Mr. Craney in violation of Section 230.12.5 of the Charles County Animal Regulations.  He was ordered to comply with the requirements stated in Section 230.5.E.1, 2, 3, 5 (a) and (b), 7 and 8 and pay of fine of $500.00 by March 1, 2016. The vote to support the motion was unanimous.

 

 

 

 

 

 

 

 

 

 

 

There being no further business, the Chairman adjourned the hearing at 8:00 p.m.
