MINUTES OF MEETNG
Tuesday, May 17, 2016
The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.
APPROVAL OF MINUTES
The minutes of the Animal Matters Hearing Board for May 3, 2016 were approved and adopted.
Citation No. 6561 – issued to William Eilliott, for the alleged violation of Section 230.10.A, Section 230.12. and Section 230.12.5 of the Charles County Animal Regulations for his dog “Venus”. Mr Elliott was present at the hearing. Testimony was heard from Officer Budd, Officer Richard Logsden, Charles County Sheriff’s Office and Mr. Elliott. Entered into evidence was a Health Department Quarantine report, a report from VCA Veterinary Referral Center and a receipt from Tri-County Animal Shelter, marked County Ex. 1. Officer Budd testified that Officer Gustafson and Officer Thomas had apprehended “Venus” on May 12, 2016. Officer Lodgsden testified that when he came on the scene, the dog took an aggressive stance towards him and he fired him weapon but missed the dog. Mr. Elliott testified that he had made all the corrections to keep his dog from jumping the fence as recommended by Animal Control and that he would be ready for inspection on May 18. 2106 from the Health Department.
Based on the testimony heard, and the evidence presented a motion was made to find Mr. Elliott in violation of Section 230.10.A, Section 230.12 and Section 230.12.5 and that he comply with the requirements stated in Section 230.12.5.E 1,2,3,5 (a), (b) (c), 6 7 and 8 of the Charles County Animal Regulations and abate the nuisance. The motion included a fine of $350.00 to be paid by July 19, 2016. The vote to support the motion was unanimous.
Citation Nos. 6582 and 6583 - issued to Ennio Rodriques, for the alleged violations of Section 230.10.A, Section 230.12,and Section 230.12.5 of the Charles County Animal Regulations for his dogs “Blade” and “Sargent”. Ms. Rodriques was present at the hearing. Testimony was heard from Officer Kevin Earle, Brandi Smith, Meghan Pelenski and Ken Fox, (witnesses for County) and Mr. Rodriques. Entered into evidence were six photos of the goat belonging to Dr. Fox. Officer Earle testified that both dogs were impounded and taken to Tri County Animal Shelter. Ms. Smith and Ms. Pelenski testified that they observed Mr. Rodriques’ dogs attack the goat which Dr. Fox tried to save but was unable to.
Based on the testimony heard, and evidence presented, a motion was made to find Mr. Rodriques in violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations and that he comply with the requirements stated in Section 230.12.5.E, 1,2,3,4,5 (a) (b) and (c), 6 and 8 of the Animal Control Regulations and abate the nuisance. The motion also included a fine of $1100.00 to be paid by July 19, 2016. The vote to support the motion was unanimous.
There being no further business, the Chairman adjourned the hearing at 8:00 p.m.
