ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND

MINUTES OF MEETNG Tuesday, August 2, 2016

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members. APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for June 7, 2016 were approved and adopted.

Citation No. 6413 — issued to James Johnson, for the alleged violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations. Ms. Geraldine McKevie was present at the hearing, and she advised the Board that the dog known as "Zeuss" had been euthanized. Officer Thomas advised the Board that she was the owner and that James Johnson (Ms. McKevie's son) told him that there were four dogs on the property and Zeuss was one of four.

A motion was made to have this citation continued until the next scheduled hearing on September 6th. The vote to support the motion was unanimous.

Citation No. 6514 — issued to James Johnson, for the alleged violation of Section 230.10.A, and Section 230.9.A, of the Charles County Animal Regulations for the dog "Dutchess". Ms. Geraldine McKevie was present at the hearing, and advised the Board that she was the owner and that she relinquished ownership of "Dutchess" to Tri-County Animal Shelter on August 1St.

A motion was made to find Ms. McKevie in violation of Section 230.10.A, with a total fine of $50.00 to be paid by September 6, 2016. The vote to support the motion was unanimous.

Citation No. 6515 and 6516 - issued to James Johnson, for the allleged violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations for her dogs "Bentley Blue" and "Ace". Ms. Geraldine McKevie was present at the hearing and claimed ownership. Testimony was heard from Officer Jeff Thomas and Ms. McKevie.

Based on the testimony heard, a motion was made to find Ms. McKevie in violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations for both citations with a total fine of $350.00 to be paid by September 6, 2016. The vote to support the motion was unanimous.

Citation No. 6584 — issued to Steven Smith, for the alleged violation of Section 230.10.E and Section 230.9.A of the Charles County Animal Regulations, for his dog "Dan". Mr. Smith was present at the hearing. Testimony was heard from Officer Alison Budd. Officer Budd withdrew the violation of Section 230.12.5 because the County's witness did not appear. Entered into evidence was a current rabies certificate and a current animal license, marked County Ex. 1.

Based on the testimony heard, and evidence presented, a motion was made to find Mr. Smith in violation of Section 230.10.A, and Section 230.9.A with a total fine of $125.00 to be paid by September 6, 2016. The vote to support the motion was unanimous.

Citations Nos. 6571— issued to Karen Lewis, for the alleged violation of Section 230.8 (a) of the Charles County Animal Regulations. Ms.Lewis was present at the hearing. Testimony was heard from Officer Jeff Thomas and Ms. Lewis. Officer Thomas testified he responded to a call for a dog locked in a car. Ms. Lewis admitted she made a mistake and said it would never happen again. Ms. Lewis reclaimed "Duke" on August 2nd from Tri County Animal Shelter.

Based on the testimony heard, a motion was made to fine Ms. Lewis $100.00, which she satisfied at the end of the hearing. The vote to support the motion passed 5-2.

Citation Nos. 6584 through 6590 — issued to Andre Boose, for the alleged violation of Section 230.10.A, Section 230.8 and Section 230.9.A for all except Citation No. 6587. Mr. Boose was present at the hearing. Testimony was heard from Officer Kevin Earle and Mr. Boose Officer Earle advised the Board the reason for the animal cruelty was unclean water and illegal tethering. Mr. Boose advised the Board he was keeping the dog known as "Holly" for his nephew and the dog known as "Bean" for his cousin and they were no longer on his property. Entered into evidence was a current rabies certificate and a current animal license for all the animals. Also entered into evidence were seven photos, marked County Ex. 1 and eight photos, marked County Ex. 2.

Based on the testimony and evidence presented, a motion was made to find Mr. Boose in violation for all the citations with a total fine of $1025.00 to be paid by October 4, 2016. The vote to support the motion was unanimous.

Citation Nos. 6596 and 6597 - issued to Bernard Henderson, tor the alleged violation of Section 230.10.A, Section 230.12 and 230.9.A. Officer Budd withdrew the violation of Section 230.12.5. Testimony was heard from Officer Alison Budd and Mr. Henderson.

Based on the testimony heard, a motion was made to find Mr. Henderson in violation of all violations and fine him a total of $330.00 to be paid by September 6, 2016. The vote passed 6-1.

Other Business:

The Clerk advised the Board that she received formal resignation of Vice-Chairman Andrew Parker, effective August 1, 2016.

There being no further business, the Chairman adjourned the hearing at 7:30 p.m.
