ANIMAL MATTERS HEARING BOARD

MINUTES OF MEETNG
Tuesday, September 20, 2016
The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Attorney Conference Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.
APPROVAL OF MINUTES
The minutes of the Animal Matters Hearing Board for September 6, 2016 were approved and adopted.
Citation No. 6519 – issued to Carole Brooke, for the alleged violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations. Ms. Brooke was present at the hearing. Testimony was heard from Officer Jeff Gustafson, Chris Greenhorn (witness for County), Carole Brooke and Frank Brooke. Entered into evidence was a copy of Board’s previous order, marked County Ex. 1 and four photos, marked County Ex. 2.
A motion was made to find Ms. Brooke in violation of Section 12.5 (failure to comply with Board’s previous Order) and that she comply with the requirements stated in Section 230.12.5.E 1, 2, 3, 4, 5 (a) and (b), and 8 of the Charles County Animal Regulations by November 1, 201, and pay a fine of $200.00 by January 17, 2017. The vote to support the motion was unanimous.
File No. 16-09 – The case of Sheila Flowers against Carlos Sanchez and Marta Varona for the alleged violation of Section 12/4/A/(1), Section 12.4.A (3) and Section 12.4.A. (4) of the Charles County Animal Regulations was called. All parties were present. Testimony was heard from Sheila Flowers, Reginald Davis, (witness for Ms. Flowers), and Carlos Sanchez.
A motion was made to find Mr. Sanchez and Ms.Varona not in violation of any of the allegations filed by Ms. Flowers. The vote to support the motion was unanimous.
File No. 16-07 – The case of Loanna Matthews against Raymond Rye and Ortiz Washington, for the alleged violation of Section 12.4.A.7 of the Charles County Animal Regulations was called. All parties were present. Testimony was heard from Loanna Matthews, Raymond Rye, and Ortiz Washington. Entered into evidence were two photos, marked County Ex. 1.
A motion was made to find Mr. Rye and Mr. Washington in violation of Section 12.4.A.7 of the Charles County Animal Regulations and ORDERED them to abate the nuisance and pay of fine of $200.00 each, and Ordered Mr. Washington to obtain a Fancier’s License by November 1, 2016. The Board received permission from the property owner and tenant for Animal Control Services to enter the property for inspection and compliance with the Board’s Order at their discretion. The vote to support the motion was unanimous.
Board Members, through secret ballot, selected Maria Padgett to fill the vacant Vice-Chair Position.
There being no further business, the Chairman adjourned the hearing at 8:00 p.m.
