ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, November 15, 2016

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Member;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for October 4, 2016 were approved and adopted.

Citation No. 6605issued to David Harley, Jr. for the alleged violation of Section 230.12.5 for his dog known as Nyla." Mr. Harley was present at the hearing. Testimony was heard from Officer Kevin Earle and Mr. Harley. Entered into evidence was a receipt from Tri County Animal Shelter in the amount of $395.00 for reclaim and boarding fees marked County Ex. 1

A motion was made to find Mr. Harley in violation of Section 230.12.5 of the Charles County Animal Regulations and allow him to reclaim his dog the following day.

 

Citation No. 6616issued to Demetrius McKinney for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations. Mr. McKinney did not appear, despite being properly served and communication from his supposed girlfriend that he would be reminded of the hearing. Testimony was heard from Officer Alison Budd and Lovie Leach (witness for County). Ms. Leach testified that her neighbor, Mr. McKinney's dog known as "Bruno" charged at her and bit her hand. She was taken to Ft. Washington Hospital for treatment and later sent to INOVA hospital to see a hand specialist. Ms. Leach is still unable to use her hand since the incident occurred. Entered into evidence was a bite report, marked County Ex. 1, five photos, marked County Ex. 2, a receipt for reclaim and boarding fees from Tri-County Animal Shelter in the amount of $335.00 and a nine page document from INOVA Hospital.

A motion was made to find Mr. McKinney in violation of all charges with a fine of $1250.00 and a total of $335.00 to Tri County Animal Shelter for reclaim and boarding fees. He is also required to comply with Section 230.12.5.E 1, 2 3, 4, 5 (a), (b) and (c), 6, 7 and 8 of the Charles County Animal Regulations, pursuant to State Code and as affirmed by the Board. If Mr. McKinney does not reclaim his dog "Bruno" within 72 hours of the hearing, it will become the property of the County.

Citation No. 6601 issued to Lora L. Williams for the alleged violation of Section 230. 8 of the Charles County Animal Regulations. Ms. Williams was present with her attorney, Mr. William Renahan, Esq. Testimony was heard from Officer Kevin Earle, Lora Williams, Shannon Garner, Dezaree Brown, Amanda Schwartz and Jarrett Levitsky. Entered into evidence was a video marked County Ex. 1 and a handbook marked Defendant Ex. A. Officer Earl advised the Board he was called to Playful Pup by the Sheriff’s Office for an attack on a dog. Ms. William; testified that she was the front desk attendant for Playful Pup and did not see the attack on the dog known as Jazzi.

A motion was made to find Ms. Williams in violation for Section 230.12.8 of the Charles County Animal Regulations with a fine of $200.00, due by January 3, 2017. The vote to support the motion was unanimous.

Citation No. 6603issued to Shannon M. Garner for the alleged violation of Section 230.8 of the Charles County Animal Regulations. Ms. Garner was present with her attorney, Matthew Emmick. Esq. Testimony was heard from Officer Kevin Earle, Shannon Garner, Lora Williams, Dezaree Brown, Amanda Schwartz and Jarrett Levitsky.

A motion was made to find Ms. Garner in violation of Section 230.8 of the Charles County Animal Regulations with a fine of $200.00, due by January 3, 2017. The vote to support the motion was unanimous.

Citation No. 6604issued to Dezaree Brown for the alleged violation of Section 230.8 of the Charles County Animal Regulations. Ms. Brown was present with her attorney, Jessica Andritz, Esq. Testimony was heard from Officer Kevin Earle, Dezaree Brown, Lora Williams, Shannon Garner, Amanda Schwartz and Jarrett Levitzsky.

A motion was made to find Ms. Brown in violation of Section 230.8 of the Charles County Animal Regulations with a fine of $200.00, due by January 3, 2017. The vote to support the motion was unanimous.

Citation No. 6606issued to Amanda E. Schwartz for the alleged violation of Section 230.8 of the Charles County Animal Regulations. Ms. Schwartz was present with her attorney, William Renahan, Esq. Testimony was herd from Officer Kevin Earle, Amanda Schwartz, Lora Williams, Shannon Garner, Dezaree Brown and Jarrett Levitzsky. Ms. Schwartz testified that she was not present at the time of the incident that occurred on October 21, 2016 at Playful Pup.

A motion was made to find Ms. Schwartz not in violation of Section 230.8 of the Charles County Animal Regulations. The vote to support the motion was unanimous.

 

 

Citation No. 6602issued to Jarrett Levitzsky for the alleged violation of section 230.08 of the Charles County Animal Regulations. Mr. Levitsky was present with his attorney, William Renahan., Esq. Testimony was heard from Officer Kevin Earle, Jarrett Levitzsky, Lora Williams Shannon Garner, Dezaree Brown and Amanda Schwartz. Entered into evidence was a folder with various documents, marked Owner Ex. 1. Mr. Levitzky testified that he is the owner of Playful Pup.

A motion was made to find Mr. Levitzsky in violation of Section 230.8 of the Charles County Animal Regulations as he is the owner of the establishment. The Board fined Mr. Levitzsky $200.00 due by January 3, 2017 and ordered that Mr. Levitzky remove all animal from Playful Pup by November 22, 2016 and that his license be suspended for 60 days ending on January 15, 2017.
