ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, February 7, 2017

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Member;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for January 3, 2017 were approved and adopted.

 

               File No. 16-14 – Jeaniene and Christopher Stewart vs. Rosalie Pike. The case of Mr. and Mrs. Stewart against Ms. Pike was called. All parties were present at the hearing. Testimony was heard from Mr. and Mrs. Stewart, Rosalie Pike and Christopher Slough (witness for owner).

            Based on the testimony heard from all the parties, a motion was made to find Ms. Pike in violation of Section 12.4.A.1, Section 12.4.A.3, Section 12.4.A.4, Section 12.4.A.6, Section 12.5.A.2, and Section 12.5.C of the Charles County Animal Regulations for her dog known as “Lady”, with a fine of $890.00 due by April 4, 2017 and that she comply with the requirements of Section 230.12.5.E 1, 2, 3 4, 5 (a)(b) and (c), 6, 7 and 8. The vote to support the motion passed.

 

Citation No. 6574 issued to Eugene Harvey for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A of the Charles County Animal Regulations. Mr. Harvey did not appear, despite being properly served. Testimony was heard from Officer Jeff Thomas.

A motion was made to find Mr. Harvey in violation of all charges with a fine of $250.00 due by March 7, 2017. The vote to support the motion passed.

 

Citation No. 6641 issued to Guy Latimer for the alleged violation of Section 230. 12 of the Charles County Animal Regulations. Ms. Latimer did not appear, despite being properly served. Testimony was heard from Officer Alison Budd.

A motion was made to find Mr. Latimer in violation for Section 230.12 of the Charles County Animal Regulations with a fine of $50.00, due by March 7, 2017. The vote to support the motion passed.

 

Citation No. 6618issued to Holly Danielson for the alleged violation of Section 230.12 of the Charles County Animal Regulations. Ms. Danielson did not appear, despite being properly served. Testimony was heard from Officer Jeff Gustafson.

A motion was made to find Ms. Danielson in violation of Section 230.12 of the Charles County Animal Regulations with a fine of $50.00, due by March 7, 2017. The vote to support the motion passed.

Citation No. 6640issued to David Kassel for the alleged violation of Section 230.10.A and Section 230.12 of the Charles County Animal Regulations for his cat “Scratch”. Mr. Kassel was present at the hearing. Testimony was heard from Officer Alison Budd, Mr. Kassel and Angie Hutchinson. Entered into evidence was a current rabies vaccination and a current animal license marked Owner Ex. 1.

A motion was made to find Ms. Kassel in violation of Section 230.10.A and Section 230.12 of the Charles County Animal Regulations with a fine of $75.00, due by March 7, 2017. The vote to support the motion passed. The fine was paid at the end of the hearing.

Citation No. 6651issued to Darius Covington for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations for his dog “Delilah”. Mr. Covington was present at the hearing. Testimony was heard from Officer Alison Budd, Mr. Covington and Eric Meyer (witness for County). Entered into evidence was a bite report marked County Ex. 1, two vet reports marked County Ex. 2 and a vet bill in the amount of $156.51 and a reclaim and boarding fee receipt for $501.51 marked County Ex. 3.

A motion was made to find Mr. Covington in violation of the above stated violations with a fine of $350.00 due by April 4, 2017, and that he could reclaim his dog the following day on the condition that he pay reclaim and boarding fees and vet fees. The motion also included that he comply with the requirements stated in Section 230.12.5.E, 1, 2, 3, 4, 5 (a), (b) and (c), 6, 7 and 8 of the Charles County Animal Regulations. The vote to support the motion passed.

 

Citation No. 6633 – issued to Pamela Fox-Harding for the alleged violation of Section 230.10.A, Section 12, Section 230.9.A and Section 12.5 of the Charles County Animal Regulations. Ms. Fox-Harding was present at the hearing. Testimony was heard from Officer Alison Budd, Ms. Fox-Harding and Angela Davidson and Mark Davidson (witnesses for County). Ms. Fox-Harding advised the Board that she relinquished ownership of “Buddy” to the County. Entered into evidence was a bite report marked County Ex. 1, two photos marked County Ex. 2 and profile tickets marked County Ex. 3.

A motion was made to find Ms. Fox-Harding in violation of all the above stated violations with a fine of $300.00 due by April 4, 2017. The vote to support the motion passed.

 

 

Citation No. 6636 – issued to Vicky Hammond for the alleged violation of Section 230.10.A and Section 230.12.5 of the Charles County Animal Regulations for her dog known as “Cami”. William Hammond appeared at the hearing and took ownership of the dog. Testimony was heard from Officer Alison Budd, Mr. Hammond and Ron Prasser (witness for County). Entered into evidence was a two part quarantine report marked County Ex. 1, a vet report marked County Ex. 2 and five photos marked Owner Ex. A  and a current rabies certificate marked Owner Ex. B.

A motion was made to find Mr. Hammond in violation of Section 230.10.A and Section 230.12.5 with a fine of $275.00 due by April 4, 2017 and that he comply with the requirements stated in Section 230.12.5.E 1, 2, 3, 4, 5 (a)(b) and (c), 6, 7 and 8 of the Charles County Animal Regulations. The vote to support the motion passed. The fine was paid at the end of the hearing.

 

Citation No. 6637 – issued to Vicky Hammond for the alleged violation of Section 230.10.A, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for her dog “Bodie”. William Hammond was present at the hearing and took ownership of the dog. Testimony was heard from Officer Alison Budd, Mr. Hammond and Ron Prasser (witness for County).

A motion was made to find Mr. Hammond in violation of the above violations with a fine of $425.00 due by April 4, 2017 and to comply with the requirements stated in Section 230.12.5.1, 2, 3 4 and 5 (a)(b)(c), 6, 7 and 8 of the Charles County Animal Regulations. The vote to support the motion passed. The fine was paid at the end of the hearing.

 

Citation No. 6638 – issued to Vicky Hammond for the alleged violation of Section 230.10.A and Section 230.12,5 of the Charles County Animal Regulations for her dog “Teddy”.

William Hammond was present at the hearing and took ownership of the dog. Testimony was heard from Officer Alison Budd and Mr. Hammond. Entered into evidence was a current animal license marked Owner Ex. 1.

A motion was made to find Mr. Hammond in violation of Section 230.10.A and Section 230.12.5 of the Charles County Animal Regulations with a fine of $275.00 and that he comply with the requirements stated in Section 230.12.5.1, 2, 3 4 and 5 (a)(b)(c), 6, 7 and 8 of the Charles County Animal Regulations. The vote to support the motion passed. The fine was paid at the end of the hearing.

 

Citation No. 6639 – issued to Vicky Hammond for the alleged violation of Section 230.10. Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for his dog “Bodette”. William Hammond appeared at the hearing and took ownership of the dog. Testimony was heard from Officer Alison Budd and Mr. Hammond. Entered into evidence was a current animal license and a current rabies certificate marked Owner Ex. 1.

A motion was made to find Mr. Hammond in violation of all three violations of the Animal Regulations with a fine of $300.00 due by April 4, 2017 and that he comply with the requirements stated in Section 230.12.5.1, 2, 3 4 and 5 (a)(b)(c), 6, 7 and 8 of the Charles County Animal Regulations. The vote to support the motion passed. The fine was paid at the end of the hearing.

 

 

There being no further business, the Chairman adjourned the hearing at 8:20 p.m.
