ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, March 21, 2017

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Member;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for February 7, 2017 were approved and adopted.

Citation No. 6632 issued to Clayton Smith, Jr., for the alleged violation of Section 230.10.A, Section 230. 12, Section 230.9.A and Section 230.8.A (6) of the Charles County Animal Regulations for his dog “Nayla”. Mr. Smith was present at the hearing.  Testimony was heard from Officer Alison Budd, and Mr. Smith. Entered into evidence was a vet report and seven photos marked County Ex. 1, a cruelty notice marked County Ex. 2, a reclaim notice marked County Ex. 3 and a three page document from All Dogs & Cats marked County Ex. 4.

A motion was made to find Mr. Smith in violation of the above charges with a fine of $415.00, due by, May 2, 2017. The vote to support the motion passed.

 

Citation No. 6635issued to Michelle Carlson for the alleged violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations. John Carlson was present at the hearing and took ownership of the dog “Marley Bear”. Testimony was heard from Officer Alison Budd and Lisa Metzer (witness for County). Entered into evidence was a bite report marked County Ex. 1, and five photos marked County Ex. 2.

 

 

 

 

A motion was made to find Mr. Carlson in violation of Section 230.12.5 of the Charles County Animal Regulations with a fine of $150.00, and that he comply with the requirements stated in Section 230.12.5.E.1, 2, 3, 4, 5 (a) and (b), 7 and 8 of the Charles County Animal Regulations. The vote to support the motion passed. Mr. Carlson satisfied the fine of $150.00 at the end of the hearing.

 

 

Citation Nos. 6575 and 6577 – issued to Ashley Hardesty for the alleged violation of Section 230.10. Section 120.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for her dogs “Diablo” and “Chaos”. Ms. Hardesty appeared at the hearing. Testimony was heard from Officer Jeffrey Thomas, Ms. Hardesty, Brock Landers and Yolanda Landers (witnesses for County). Entered into evidence was a receipt for reclaim and boarding fees in the amount of $1,215.25 and vet bills in the amount of $305.00.

A motion was made to find Ms. Hardesty in violation of all the violations listed above  with a fine of $980.00 due by June 6, 2017 and that she comply with the requirements stated in Section 230.12.5.1, 2, 3 4, 5 (a)(b), 6, 7 and 8 of the Charles County Animal Regulations. The vote to support the motion passed.

 

 

 

 

 

There being no further business, the Chairman adjourned the hearing at 7:45 p.m.
