ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, April 4, 2017

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Member;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for March 21, 2017 were approved and adopted.

            Citation No. 6661 issued to Ray Thrift for the alleged violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations for his dog “Scooby Doo”. Mr. Thrift did not appear at the hearing, despite being properly served. Testimony was heard from Officer Alison Budd.

A motion was made to find Mr. Thrift in violation of the above charges with a judgment in the amount of $200,00. The vote to support the motion passed.

Citation No. 6657issued to Candice Nester for the alleged violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations. Ms. Nester was present at the hearing. Testimony was heard from Officer Alison Budd and Ms. Nester. Officer Budd advised the Board that Ms. Nester relinquished ownership of the cat over to the County. Entered into evidence were 12 photos marked County Ex. 1.

A motion was made to find Mr. Nester in violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations with a fine of $200.00, which was deferred. The vote to support the motion passed.

Citation No. 6569 – issued to Robert Norman for the alleged violation of Section 230.12, and Section 230.12.5 of the Charles County Animal Regulations for his dog “Max” Mr. Norman appeared at the hearing. Testimony was heard from Officer Alison Budd and Mr. Norman. Entered into evidence was a 3 page profile ticket from Tri-County Animal Shelter.

A motion was made to find Mr. Norman in violation of  Section 230.12 and Section 230.12.5 with a fine of $100.00 due by May 2, 2017 and that he comply with the requirements stated in Section 230.12.5.1, 2, 3 5  (a)(b), 6, and 8 of the Charles County Animal Regulations. The vote to support the motion passed.

Citation No. 6660 – issued to Cynthia Littleford for the alleged violation of Section 230.10.A, Section 230.8.A (7) and Section 230.9.A for her dog “Sprinkles” and two puppies. Ms. Littleford did not appear at the hearing, despite being properly served. Testimony was heard from Officer Alison Budd.
           A motion was made to find Ms. Littleford in violation of the above charges with a judgment in the amount of $300.00.

Citation No. 6663 – issued to Andres Carranza for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations for his dog “Spot”. Mr. Carranza was present at the hearing. Testimony was heard from Officer Alison Budd, Officer Jeffrey Thomas and Mr. Carranza. Entered into evidence was a quarantine agreement marked County Ex. 1, a call sheet form Sheriff’s Office marked County Ex. 2, two photos marked County Ex. 3, and a receipt from Tri- County Animal Shelter for boarding and reclaim fees marked County Ex. 4. Officer Thomas testified that in his opinion “Spot” was a very aggressive dog that charged at him several times, and that Mr. Carranza had no control over this dog.           

A motion was made to find Mr. Carranza in violation of Section 230.12 and Section 230.12.5 for his dog “Spot” and that his dog be humanely euthanized. The Board advised Mr. Carranza that he had 30 days to appeal the Board’s decision and that the Order would be stayed 21 days. The vote to support the motion passed.

Citation Nos. 6653 through 6656 – issued to Jordan Strader for the violation of Section 230.10.A, Section 230.8 (A) (6) for the dogs “Jace”, “Pearl”, “Fat Momma” and “Blue”. Mr. Trent Queen was present at the hearing and took ownership of all four dogs. Testimony was heard from Officer Alison Budd, Officer Jeffrey Thomas and Mr. Queen. Officer Budd testified that the dog “Pearl” was found in a car with no food or water and the kennels where the other dogs were found had frozen water only. Entered into evidence was a temperature reading for Waldorf, MD marked County Ex. 1, a call sheet from Charles County Sheriff’s Office, six photos marked County Ex. 3, a cruelty investigation marked County Ex. 4 and minutes from a 2001 hearing marked County Ex. 5.

A motion was made to find Mr. Queen in violation of all the charges for each citation with a fine of $1,000.00 due by July 18, 2017, and that Animal Control Services inspect the property and animals as they deem necessary. The vote to support the motion passed.

 

There being no further business, the Chairman adjourned the hearing at 8:50 p.m.
