ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, May 2, 2017

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Member;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for April 4 2017 were approved and adopted.

               File No. 17-03 – The case of Dr. and Mrs. King against Annie Boyden was called. All parties were present at the hearing. Testimony was heard from Mr. and Mrs. King, Annie Boyden and Brent Wilburn (owner of property). Entered into evidence were three photos marked County Ex. 1.  Mr. Wilburn advised the Board he recently installed a 6’ fence to keep the dogs from being at large in the future.

            A motion was made to find Ms. Boyden in violation of Section 12.4.A.1, Section 12.4.A.3 and Section 12.5 of the Charles County Animal Regulations for their two dogs “Rose” and “Razor”, with all fines suspended on the condition that they do not appear before the Board again for the next 12 months, and they abate the nuisance. The vote to support the motion passed.

 

               Citation Nos. 6671 – issued to Daniel McCoy for the alleged violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations for his dog “Sarge”. Mr. McCoy was present at the hearing. Testimony was heard from Officer Jeffrey Thomas and Mr. McCoy, Entered into evidence were three photos marked County Ex. 1, a cruelty investigation report marked County Ex. 2, a vet invoice marked Owner Ex. 1, a current rabies certificate marked Owner Ex. 2, and a spay/neuter invoice marked Owner Ex. 3.    

A motion was made to find Mr. McCoy in violation of Section 230.10.A with a fine of $40.00 due by June 6, 2017. The vote to support the motion passed.

              

Citation No. 6672 – issued to Daniel McCoy for the alleged violation of Section 230.10.A, Section 230.8.A (6) and Section 230.9.A of the Charles County Animal Regulations for his dog “Lucy. Mr. McCoy was present at the hearing. Testimony was heard from Officer Jeffrey Thomas and Mr. McCoy.

A motion was made to find Mr. McCoy in violation of Section 230.10.A and Section 230.8.A (6) of the Charles County Animal Regulations with a fine of $50.00 due by June 6, 2017. The vote to support the motion was passed.

 

            Citation No. 6663 – issued to Shontell Jones for the alleged violation of Section 230.10.A, Section 230.12, Section 230.8 (5) and (6), Section 230.9.A and Section 23.12.5 of the Charles County Animal Regulations for her dog “Sasha”. Ms. Jones was present at the hearing. Testimony was heard from Officer Kevin Earle, Mr. and Mrs. “O’Neal (witnesses for County),  Shontell Jones and Kevin Jones, Entered into evidence was a call sheet from Sheriff’s Office marked County Ex. 1, one photo marked County Ex. 2. Officer Earle testified the dog did not have potable water or appropriate bedding in the kennel, and the temperature was freezing. Ms. Jones advised the Board that she purchased an insulated water bucket that cannot freeze at the advice of Officer Earle and that she has the appropriate bedding in the kennel at all times since the incident.

A motion was made to find Ms. Jones in violation of Section 230.12, Section 230.8 and Section 230.12.5 of the Charles County Animal Regulations with a fine of $150.00 due by July 18, 2017. The vote to support the motion was passed.

 

Citation Nos. 6664, 6665 and 6666 – issued to Trent T. Queen for the alleged violations of 230.10.A, Section 230.8.A (6) and Section 230.9.A of the Charles County Animal Regulations.  Mr. Trent did not appear, despite being properly served. Testimony was heard from Officer Alison Budd. Entered into evidence were five pages of documents, including a vet report from Waldorf Clinic and one photo marked County Ex. 1.

.A motion was made to find Mr. Trent in violation of all three Sections of the Animal Control Regulations and fine him a total of $2,850.00 in fines and a total of $1530.00 for reclaim and boarding fees from Tri-County Animal Shelter.

 

 Citation No. 6667- issued to Trent T. Queen for the alleged violation of 230.10.C of the Charles County Animal Regulations. Mr. Trent did not appear, despite being properly served. Testimony was heard from Officer Alison Budd.

           A motion to find Mr. Trent in violation of Section 230.10.C with a fine of $250.00 was due immediately. The vote to support the motion was passed.

 

 

Other Business:

 

Maria Padgett was officially elected as the new Chairman by the members of the Charles County Animal Matters Board.

 

 

 

There being no further business, the Chairman adjourned the hearing at 8:30 p.m.
