ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, June 6, 2017

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Member;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for May 2, 2017 were approved and adopted.

               File No. 17-03 – The case of Vanessa Conine against Samuel Greene was called. Neither of the parties were present. A motion was made to dismiss the case since as neither the complainant or the owner appeared at the hearing. The vote to support the motion passed.

 

            File No. 17-04 – The case of Herbert McCall against Arthur Williams was called. Both parties were present at the hearing. Testimony was heard from Mr. McCall and Mr. Williams. Entered into evidence were 11 photos and a two page report marked Complainant Ex. 1.

            A motion was made to find Mr. Williams in violation of Section 12.5.A.1 with a fine of $150.00 due on June 7, 2017 and to comply with the requirements stated in Section 12.5.E. 1, 2, 3, 5, 6, 7 and 8 of the Charles County Animal Regulations.

 

               Citation No. 6608– issued to Sandra Fair for the alleged violation of Section 230.12.5 of the Charles County Animal Regulations for her dog “Jordan. Ms. Fair was present at the hearing. Testimony was heard from Officer Kevin Earle and Ms. Fair. Entered into evidence were 13 photos, marked County Ex. 1, a cruelty investigation report marked County Ex. 2, a vet invoice marked Owner Ex. 1, a current rabies certificate marked Owner Ex. 2, and a spay/neuter invoice marked Owner Ex. 3. 

A motion was made to find Mr. McCoy in violation of Section 230.10.A with a fine of $40.00 due by June 6, 2017. The vote to support the motion passed.

Citation Nos. 6691 thru 6693 – issued to Sue Ann Hagler for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations. Ms. Hagler was present at the hearing. Testimony was heard from Officer Alison Budd and Ms Hagler. Entered into evidence were four pictures marked County Ex. 1, and a current rabies certificate and a current animal license for all three dogs marked County Ex. 2.

            A motion was made to find Ms. Hagler in violation of all three violations for the three citations with a total fine of $600.00 due by July 18, 2017. The vote to support the motion passed.

 

            Citation No. 6695 – issued to Carolyn Toye for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations. Ms. Toye was present at the hearing. Testimony was heard from Officer Alison Budd, Officer Jeff Gustafson, Brenda Jamison (witness for County) and Ms. Toye.  Entered into evidence was a bite report marked County Ex. 1, a vet report marked County Ex. 2, a trap agreement marked County Ex. 3, and six photos marked County Ex. 4.    

            A motion was made to find Ms. Toye in violation of Section 230.10.A, Section 230.12 and Section 230.9.A with a total fine of $75.00 due by the close of business on July 18, 2017.  The vote to support the motion passed. 

 

            Citation Nos. 6696 and 6697 – issued to Jasen Weber for the alleged violation of Section 230.8.A (6) of the Charles County Animal Regulations for his dogs “Buddy” and “Diamond”.  Testimony was heard from Officer Alison Budd, Michael Meyers (witness for County) and Mr. Weber. Entered into evidence was a Sheriff’s Office call sheet marked County Ex. 1, and three photos marked County Ex. 2.

            A motion was made to find Mr. Weber in violation of Section 230.A (6) for both citations with a total fine of $1,000.00 which Mr. Weber satisfied at the end of the hearing. The vote to support the motion was passed.

 

            Citation No. 6673 – issued to Andres Carranza for the alleged violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations for his dog “Spot”. Mr. Carranza was present at the hearing. Testimony was heard from Animal Control Officer Jeff Thomas, Officer Jerome Jackson, Officer Daniel Raby (both from Charles County Sheriff’s Office and Mr. Carranza.

               The Board requested additional documentation before entering an Order on the current citation and before ruling on his Motion to Amend the Board’s previous Order. Mr. Carranza consented to having the citation and ruling on the Motion continued to the meeting of July 18 2017.

                

 

 

 

There being no further business, the Chairman adjourned the hearing at 9:00 p.m.
