ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, August 1, 2017

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Member;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for June 6, 2017 were approved and adopted.

               File No. 17-05– The case of Monica Jimison against Jennifer Lucas was called. Both parties were present. Testimony was heard from Ms. Jimison and Jennifer and Sean Lucas. Entered into evidence was an Emergency room report, marked Complainant Ex. 1, a bite report, marked Complainant Ex. 2 and a current rabies certificate and a current animal license, marked Complainant Ex. 3.

            A motion was made to find Mrs. Lucas in violation of Section 12.5.C of the Animal Control Regulations with a fine of $150.00 due by October 5, 2017. The vote to support the motion passed.

 

               Citation No. 6620 – issued to Kimberly Buchanan for the alleged violation of Section 230-12 and Section 230.12.5 of the Charles County Animal Regulations for her dog “Brutus”. Marvin Buchanan was present at the hearing, and had no objection to being named as owner of the dog. Testimony was heard from Officer Jeff Gustafson, Mr. Buchanan and Jessica Martinez (witness for County). Entered into evidence were six photos marked County Ex. 1.

 

 

 

 

A motion was made to find Mr. Buchanan in violation of Section 230.12 and Section 230.12.5 with a fine of $100.00 due by September 5, 2017. Ms. Buchanan had paid the $50.00 fine for Section 230.12 violation prior to the hearing. The vote to support the motion passed.

 

 

Citation Nos. 6701– issued to Ortiz Washington for the alleged violation of Section 230.10.B and Section 230.12.4.A (9) of the Charles County Animal Regulations. Mr. Washington was present at the hearing. Testimony was heard from Officer Alison Budd and Mr. Washington. Entered into evidence were previous minutes from September 2016 marked County Ex. 1, and an expired fancier license marked County Ex. 2. Mr. Washington advised the Board he was moving out of the County, effective August 4, 2017.

            A motion was made to find Mr. Washington in violation of Section 230.10.B with a fine of $150.00, suspended if he is no longer residing in the County. The vote to support the motion passed.

 

 

            Citation No. 6698 – issued to Robert Foster for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations. Mr. Foster was present at the hearing. Testimony was heard from Officer Alison Budd, and Mr. Foster.  Entered into evidence was a bite report, marked County Ex. 1, previous minutes from August 2011, marked County Ex. 2, and a Waldorf emergency care vet report, marked County Ex. 3. Mr. Foster advised the Board that he euthanized his dog “Ruby”.

            A motion was made to find Mr. Foster in violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations with a fine of $550.00 due by September 5,    2017.  The vote to support the motion passed. 

 

            Citation No. 6703 – issued to Tiffany Wedding for the alleged violation of Section 230.12 and Section 230.12.5of the Charles County Animal Regulations for her dog “Brownie”. Ms. Wedding was present at the hearing. Testimony was heard from Officer Alison Budd, Ms. Wedding, Lance Williams, David and Cathy Stoffer (witnesses for County). Entered into evidence was a bite report, marked County Ex. 1, two photos, marked County Ex. 2, six photos marked, County Ex. 3, medical records for the dog belonging to Mr. and Mrs. Stoffer named “Chance”, marked County Ex. 4 and a Sheriff’s report, marked County Ex. 5. A motion was made to find Ms. Wedding in violation of  Section 230.12 and Section 230.12.5 with a  fine of $200.00 due by September 5, 2017 and that she comply with the requirements stated in Section 230.5.A.1, 2,3,4, 5 (a), (b) and (c), and 8 of the Charles County Animal Regulations. The vote to support the motion was passed.

 

            Citation No. 6609 and 6610 – issued to Tony Ford for the alleged violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations for his dogs “Master” and “King”. Mr. Ford was present at the hearing. Testimony was heard from Animal Control Officer Kevin Earle and Mr. Ford. Mr. Ford provided a current animal license and a current rabies certificate to the Board.

                A motion was made to find Mr. Ford in violation of Section 230.10.A and Section 230.9.A with a total fine of $250.00 due by September 5, 2017. The vote to support the motion was passed.  

           

            Citation No. 6715 and 6716 – issued to Dody Roper for the alleged violation of Section 230.12 for her dogs “Rocky” and “Xena”. Ms. Roper was present at the hearing. Testimony was heard from Officer Earle and Ms. Roper.

            A motion was made to find Ms. Roper in violation of Section 230.12 of the Charles County Animal Regulations for both dogs with a total fine of $50.00 due by September 5, 2017. The vote to support the motion was passed. Ms. Roper satisfied the fine of $50.00 at the end of the hearing.

 

            Citation Nos. 6611 and 6613 – issued to DeWayne Beverly for the alleged violation of Section 230/10.A, Section 230.9.A and Section 230.12.5 for his dogs “Lacy” and “Rock”. Mr. Beverly was present at the hearing. Testimony was heard from Officer Earle, Mr. Beverly and Julia and Edward Beaudry (witnesses for County). Mr. and Mrs. Beaudry advised the Board that their cat was killed by Mr. Beverly’s dogs. Mr..Beverly provided a current rabies certificate and a current animal license for his dogs to the Board.

            A motion was made to find Mr. Beverly in violation of the above allegations with a total fine of $450.00 due by September 5, 2017. The vote to support the motion was passed.

 

 

            Citation No. 6714 – issued to Destinee Hicks for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 for her dog “Omar”. Reuel Hicks was present at the hearing and had no objection to being named owner of the dog Omar”. Testimony was heard from Officer Earle, Ms. Hicks and Nicholas Lawless (witness for County). Entered into evidence was one photo marked County Ex. 1 and a bite report marked County Ex. 2. Mr. Hicks provided a current rabies certificate and a current animal license for his dog to the Board.

            A motion was made to find Ms. Hicks in violation of the Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 with a fine of  $275.00 due by September 5, 2017 and the comply with the requirements stated in Section 230.5.E 1,2,3,4,5 (a) (b) and (c) and 6,7 and 8 of the Charles County Animal Regulations.

 

           

 

There being no further business, the Chairman adjourned the hearing at 10:45 p.m.
