ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, December 19, 2017

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members;

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for December 19, 2017 were approved and adopted.

Citation No. 6676 and 6677– issued to Kimberly Pilkerton for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for her dogs “Kissa” and “Mann”.  Ms. Pilkerton was present at the hearing, but left the hearing before the the Decision and Order was made by the Board. Testimony was heard from Officer Jeffrey Thomas, Ms. Pilkerton, Deley Jacks and Deborah Carle (witnesses for County). Entered into evidence was a hospital report for the victim Ms. Carle and five photos marked County Ex. 1 and an invoice from Tri-County Animal Shelter in the amount of $605.00 for shelter fees for the dog “Kissa”. Officer Thomas advised the Board that the dog known as “Mann” had been euthanized at the request of the owner before the hearing.

               A motion was made to find Ms. Pilkerton in violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5.F with a fine of $750.00 to be paid by March 6, 2018 and $605.00 for shelter fees to Tri-County Animal Shelter for boarding fees for Citation No. 6676 and in violation of Section 12 and Section 230.12.5 with all fines suspended. The vote to support the motion passed.

 

 

 

 

 

 

              

            File No. 17-12 – The case of Dr. and Mrs. King against Ronald Wilburn, Jr.was called. All parties were present at the hearing. Testimony was heard from Dr. King and Ronald Wilburn, Jr. Entered into evidence were seven photos marked County Ex.1 and an attendance record from the schools the owner’s children attend marked Owner Ex. A. A motion was made to find Mr. Wilburn not in violation of all the alleged charges and the case was dismissed for insufficient evidence. The vote to support the motion passed.

 

            File No. 17-08 – The case of Derek and Monique Graham was called. All parties were present at the hearing. Testimony was heard from Mr. and Mrs. Graham and Shawn Butler. Entered into evidence were three photos marked Complainant Ex. 1. After hearing testimony from all parties, a motion was made to find Mr. Butler in violation of 230.12.4.A.1 (animal at large) and Section 230.11.A,B, (1), (2),(3)(4), C, D, 1, 2, (a),(b),(c)(d), E and F. The vote to support the motion passed.

 

 

           

 

 

 

 

           

There being no further business, the Chairman adjourned the hearing at 9:00 p.m.
