MINUTES OF MEETING - CASES

Tuesday, February 4, 2014

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES

 

The minutes of the Animal Matters Hearing Board for April 15, 2014, were approved and adopted.

 

            Citation No. 6332 – issued to Janitia L. Jones, 4413 Quillen Circle, Waldorf, MD 20602 for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations for her dogs “Lennox”.  Ms. Jones was present at the hearing and not represented by counsel. Testimony was heard from Officer Kevin Earle and Ms. Jones.

Based on the testimony heard, the Chairman made a motion to continue this case until the next hearing on May 20, 2014 to allow Ms. Jones to get a current rabies certificate and a current animal license for her dog “Lennox” and provide them to the Animal Matters Hearing Board.

 

            Citation Nos. 6215 and 6306 – issued to Rashpel Singh, 3712 Joy Lane, Waldorf, MD 20603 for the alleged violation of Section 230.12, Section of the Charles County Animal Regulations for his dogs “Raffl” and “Spike”. Mr. Singh was not present at the hearing, and there being no request for a continuance, a judgment in the amount of $100.00 for both citations was entered and these cases were referred to the State’s Attorney’s Office for failure to appear.

            Citation No. 6267 – issued to Thien Ha Nguyen, 6330 Fire Tower Road, Welcome, Maryland 20693 for the alleged violation of Section 230.8.A.(6) of the Charles County Animal Regulations. Ms. Nguyen was present at the hearing and not represented by counsel.  Ms. Nguyen admitted to being in violation of Section 230.8.A (6) of the Charles County Animal Regulations for her dog “Thor”. Testimony was heard from Officer Jeff Thomas and Ms. Nguyen. Entered into evidence were 20 photos marked AC Ex. 1, five photos, marked AC Ex. 2, 37 photos, marked AC Ex. 3 and veterinarian records, marked AC Ex. 4.

            Based on the testimony and evidence presented, the Vice Chair made a motion to find Ms. Nguyen in violation of Section 230.8 (animal cruelty) for her dog “Thor” and fine her a total of $500.00 and suspend $200.00 from that amount on the condition that she obey all laws for 18 months. A second was made and the vote passed unanimously.  The Vice Chair made a second motion to have Animal Control Services inspect Ms. Nguyen’s property as needed to check on the welfare of her other animals for 18 months. A second was made and, again the vote passed unanimously.  Ms. Nguyen satisfied the balance of $300.00 at the end of the hearing.

            Citation No. 6268 – issued to Tracy Icenhower, 4840 Mary’s Lane, White Plains, MD 20695 for the alleged violation of Section 230.12.5 of the Charles County Animal Regulations. Ms. Icenhower was present at the hearing and not represented by counsel. Ms. Icenhower denied being in violation of Section 230.12.5 of the Animal Control Regulations. Testimony was heard from Officer Thomas and Ms. Icenhower. Testimony was also heard from Janet Morgan, Mike Watson and Donald Taylor. (witnesses for County). Entered into evidence was a receipt from Tri-County Animal Shelter marked AC Ex. 1, six photos marked, AC Ex. 2 and medical bills and photos marked AC Ex. B.

            Based on the testimony heard, a motion was made to have the dog “Molly” euthanized by Tri-County Animal Shelter the following day and not impose any fines. A second was made and the vote passed unanimously. 

            Citation Nos. 6264 and 6265 – issued to Barbara Torres, 2460 Streamview Drive, Waldorf, Maryland 20603 for the alleged violation of Section 230.12.5 of the Charles County Animal Regulations. Ms. Torres was present at the hearing and not represented by counsel. Ms. Torres denied being in violation of Section 230.12.5 for her dogs “Thunder” and “Lightning”. Testimony was heard from Officer Budd and Ms. Torres. Testimony was also heard from Leslie Griffin, Jacques Wilson and Marilyn Wilson (witness for County) and Sean Hackney (witness for owner). Entered into evidence was a bite report marked AC Ex. 1, six photos marked AC Ex. 2, vet records marked AC Ex. 3. Also entered into evidence were eight photos marked Owner Ex.A.

Based on the testimony and evidence presented, the Vice Chair made a motion to find Ms. Torres in violation f Section 230.12.5 of the Charles County Animal Regulations and order her to comply with the requirements in Section 230.12.5.A. 1, 3, 5 (a) (b) and (c), 7 and 8 and fine her a total of $200.00 and suspend $150.00 on the condition that she obey all laws. A second was made and the vote passed unanimously. Ms. Torres satisfied the balance of $50.00 at the end of the hearing.

            Citation Nos. 6340 and 6341 – issued to Jessica Rice, 805 Kirkwood Road, Waldorf, MD 20602 for the alleged violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations for her dogs “Piglet” and “Lucky”. Ms. Rice was present at the hearing and not represented by counsel.  Ms. Rice denied being in violation of Section 230.12 and 230.12.5 of the Charles County Animal Regulations for her two dogs. Testimony was heard from Officer Earle, Ms. Rice and Florence Lockhart (witness for County). Ms. Rice informed the Board that she is moving out of the County with her two dogs within the next two weeks.

            Based on the testimony heard, the Vice Chair made a motion to find Ms. Rice in violation of Section 12 and Section 12.5 for both citations and fine her a total of $200.00 for both citations and suspend that amount on the condition that she keep the dogs in the kennel until she moves out of the county and also have “Piglet” microchipped before moving away. A second was made and the vote passed unanimously. The Board also Ordered Ms. Rice to let them know if she decides not to move and stay in the County.

 

 

 

 

 

 

 

There being no further business, the Chairman adjourned the hearing at 9:00 p.m.            .
