The Charles County Commissioners will conduct a Public Hearing on Tuesday, September 12, 2017, at 6:00 p.m., in the County Commissioners' Meeting Room of the Charles County Government Building, La Plata, Maryland, to consider Zoning Text Amendment #16-144 and Subdivision Regulations Amendment #16-02, newly numbered Bill #2017-06 titled Appeals of Decisions to the Board of Appeals.

The proposed bill would amend and reinstate with changes Chapter 278, Article IX, Section 106 of the Subdivision Regulations, and Chapter 297, Article XXV, Section 409, 411,412, and 417 of the Zoning Regulations for the purpose of establishing that appeals of Planning Commission decisions may be taken to the Board of Appeals; establishing that the Board of Appeals may not hear appeals of decisions of the County Commissioners; clarifying the notice requirements for hearings of special exceptions, variances, and nonconforming uses; clarifying that the rights of aggrieved persons and interested persons apply to hearings of special exceptions, variances, and nonconforming uses; clarifying that parties to decisions of administrative officials may take appeals to the Board of Appeals; establishing the scope of review of appeals heard by the Board of Appeals as a review of the record of the decision being appealed; clarifying the remedies of the Board of Appeals in reviews of Planning Commission decisions; and, clarifying the burden of proof in appeals heard by the Board of Appeals.
Citizens wishing to make oral or written comments are encouraged to attend the hearing. Those individuals or representatives of groups wishing to speak must sign in. Speaker sign-up will begin 30 minutes (½ hour) prior to the hearing and will end at the commencement of the hearing. Each speaker will be allotted three (3) minutes to speak. Written comments may be submitted in lieu of oral testimony, or to expand upon oral testimony, to Danielle Mitchell, Clerk to the County Commissioners, at firstname.lastname@example.org, or to P.O. 2150, La Plata, Maryland 20646. Written comments will be accepted until the Commissioners close the public record. The County Commissioners reserve the right to extend the time frame allotted for the public hearing. Bill #2017-06 is available for review in the County Commissioners Office in the County Government Building.
