ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, February 6, 2018

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES

The minutes of the Animal Matters Hearing Board for January 16, 2017 were approved and adopted.

 

 

 

            File No. 17-10 – Sandip Patel vs. Robert Sorrells – The case of Sandip Patel against Robert Sorrells was called. Both parties were present at the hearing. Testimony was heard from Sandip Patel, Rushina Patel and Robert Sorrells. Entered into evidence was one photo marked Complainant E. 1.

            A motion was made to find insufficient evidence to find Mr. Sorrells in violation of Section 12.4.A.6 of the Charles County Animal Regulations. No further action was taken. The vote to support the motion passed.          

 

            File No. 18-01 – Heather Jordan vs. Duy Mitchell – The case of Heather Jordan against Duy Mitchell was called. Mr. Mitchell failed to appear at the hearing despite being served with a copy of the citation on January 10, 2018 and no continuance was requested.  Entered into evidence were 15 photos marked Complainant Ex. 1.

 

 

            A motion was made to have this case referred to the State’s Attorney’s Office for failure to appear with a judgment in the amount of $800.00 due by March 20, 2018. The vote to support the motion passed.

 

            Citation No. 6725 - issued to Angie Hutchinson for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations for her cat known as “Scrat”. Ms. Hutchinson was present at the hearing. Testimony was heard from Officer Alison Budd and Ms. Hutchinson. Ms. Hutchinson was able to provide proof of a current rabies certificate issued on December 15, 2017 expiring on December 5, 2018.

            A motion was made to find Ms. Hutchinson in violation of Section 230.12 with a fine of $50.00 and in violation of Section 230.9.A with a fine of $50.00, unless she provides proof to the Office of the County Attorney by February 9, 2018, at which time no fine would be due. Ms. Hutchinson provided proof of a current license on February 7, 2018 to the Office of the County Attorney. Ms. Hutchinson has until the close of business on March 6, 2018 to satisfy the balance of $50.00. The vote to support the motion passed.

 

 

            Citation No. 6726 – issued to Chester Martin for the alleged violation of Section 230.10.B of the Charles County Animal Regulations. Mr. Martin failed to appear at the hearing and no request for a continuance was requested.

            A motion was made to refer this case to the State’s Attorney’s Office for failure to appear with a judgment in the amount of $150.00 due by February 20, 2018. The vote to support the motion passed.

 

            Citation No. 6726 – issued to Forrest Ricketts for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations for his dog known as “Remy”.  Mr. Ricketts was present at the hearing. Testimony was heard from Officer Budd and Mr. Ricketts. Entered into evidence was a current rabies and a current animal license marked Owner Ex. 1.

            A motion was made to find Mr. Ricketts in violation of Section 230.12 for his dog being at large with a fine of $50.00, which he satisfied at the end of the hearing. The vote to support the motion passed.

 

            Citation Nos. 6750 and 6670 – issued to Elizabeth Vargas for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations for her dogs known as “King” and “Blue”. Ms. Vargas was present at the hearing. Testimony was heard from Officer Alison Budd and Ms. Vargas. Entered into evidence was a quarantine report marked County Ex. 1 and a current rabies certificate for both dogs marked Owner Ex. A.

            A motion was made to find Ms. Vargas in violation of Section 230.12 with a total fine of $100.00 for both citations and $100.00 suspended for both citations for Section 230.10.A (animal license) if provided by March 6, 2018 to the Office of the County Attorney. The vote to support the motion passed.

 

 

 

Citation No. 6626 – issued to Mary Lipscomb for the alleged violation of Section 230.10.A. Section 230.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for her dog known as “Angel”. Ms. Lipscomb was present at the hearing. Testimony was heard from Officer Jeff Gustafson, Joseph and Teresa Burch (witnesses for County) and Ms. Lipscomb. Mr. Burch testified that Ms. Lipscomb’s dog bit him and also his dog, who has had two surgeries for his injuries. Entered into evidence was a receipt for reclaim and boarding fees in the amount of $395.00 marked County Ex. 1, 13 photos marked County Ex. 2, a vet report and a quarantine report marked County Ex. 3. Ms. Lipscomb advised the Board she could not handle the dog anymore and signed her dog over to the County that evening. A motion was made to find Ms. Lipscomb’s dog dangerous and vicious and that he be humanely euthanized in accordance with Section 230.12.F of the Charles County Animal Regulations. The Board found her in violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 12.5 with a total fine of $450.00 due by the close of business on April 3, 2018. The vote to support the motion passed.

 

            Citation Nos. 6709, 6710, 6729 and 6669 – issued to Andrea Reeder for the alleged violation of Section 230.12 of the Charles County Animal Regulations for her dogs, “Spartan”,
“Maggie”, Fussie”, and “Zeus”. Kevin Reeder was present at the hearing and took ownership of the dogs. Testimony was heard from Officer Budd and Mr. Reeder.

            A motion was made to find Mr. Reeder not in violation of Section 230.12 because he was in immediate pursuit of the dogs at large. No fines were issued. The vote to support the motion passed.

 

 

 

 

           

 

 

 

 

 

 

 

 

 

           

There being no further business, the Chairman adjourned the hearing at 9:00 p.m.
