 ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND

MINUTES OF MEETNG

Tuesday, May 19, 2015

 

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES
 

The minutes of the Animal Matters Hearing Board for May 5, 2015 were approved and adopted. 

 

            Citation No. 6439 and 6440 – issued to Barbara Torres, 2446 Streamview Drive, Waldorf,  Maryland 20603, for the alleged violations of Section 230-12, Section 230.12.4.A (9) and Section 230.5 of the Charles County Animal Regulations for  dogs “Thunder” and “Lightning” Ms. Torres was present at the hearing and not represented by counsel.  Ms. Torres admitted to being in violation of Section 230.12.4.A (9) and Section 230.12.5 of the Charles County Animal Regulations. Testimony was heard from Officer Jeff Gustafson, Ms. Torres and Kimberly Thomas (witness for County). Entered into evidence was a receipt for reclaim and boarding fees at Tri-County Animal Shelter in the amount of $410.00 marked County Ex. 1, and a vet report, a  receipt from Johns Hopkins, a diagram and 19 photos marked County Ex. 2 and a copy of prior minutes from May 6, 2014 hearing.

Based on the testimony and evidence presented, Vice Chairman, made a motion to find Ms. Torres in violation of  Section 230.12.4.A(9) and Section 230.12.5 for her two dogs, with a fine of $280.00 to be satisfied by June 16, 2015, and to comply with the requirements of Section 230.5.E (2), (6) and (8) by June 2, 2015.  A second was made and the vote passed unanimously. The Board also ordered that Animal Control Service check for compliance.

 

 

 

Citation Nos. 6472 and 6478 – issued to Channing Hayes, 2237 Sandlewood Drive, Waldorf, Maryland 20601 for the alleged violation of Section 230.10.A, Section 230.12, and Section 230.9.A  of the Charles County Animal Regulations.  Channing Hayes was present at the hearing and not represented by counsel. Ms. Hayes admitted to being in violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations. Testimony was heard from Ms. Hayes, Officer Kevin Earle and Walter Hickey (witness for County).  Entered into evidence was a vet report marked County Ex. 1.

Based on the testimony and evidence presented, the Vice- Chair made a motion to find Ms. Hayes in violation of Section 230.10.A,  Section 230.9.A  and Section 230.12.5 of the Charles County Animal Regulations for her dogs “Hugo” and “Ninja.”, and that she comply with the requirements stated in Section 230.12.5.E. 1, 2, 3, 5 (a) and (b), 6 and 8, provide proof of a current rabies vaccination and a current animal license to the Office of the County Attorney by June 2, 2015 and satisfy the  fine of $200.00 by the close of business June 16, 2015. A second was made and the vote passed unanimously.  

 

Citation Nos. 6471 and 6475 – issued to Tyeisha Fantroy, 4903 Astor Street, Washington DC 20019 for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for her dogs “Nino” and “Snatch. Ms. Fantroy was present at the hearing and not represented by counsel. Testimony was heard from Officer Earle, Ms. Fantroy and Joe Kimble (witness for County). Entered into evidence was a receipt from Tri-County Animal Shelter for reclaim and boarding fees in the amount of $340.00.

Based on the testimony heard, the Chairman made a motion to find Ms. Fantroy in violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations for her dogs, with a fine of $200.00 to be satisfied by the close of business on June 16, 2015 and that whenever in Charles County with her dogs she comply with the requirements in Section 230.12.5.E, 3, 5 (a) and (b) and 6. A second was made and the vote passed.

 

File No. 15 –12   Martha Lee vs. Kenneth and Tammy Brown. All parties were present at the hearing and not represented by counsel. Testimony was heard from Marsha Lee, and Kenneth and Tammy Brown.  

Based on the testimony heard, the Chairman made a motion to find insufficient evidence to find Mr. and Mrs. Brown in violation of Section 12.4.A.4 of the Charles County Animal Regulations.  A second was made and the vote passed unanimously.

 

            File No. 15-11 – Kelli Green vs. Dionne Hughes. Both parties were present at the hearing and not represented by counsel. Testimony was heard from Ms. Green and Ms. Hughes. Entered into evidence were 13 photos marked Complainant Ex. 1 and eight photos marked Complainant Ex. 2.  

Based on the testimony and evidence presented, the Chairman made a motion to find Ms. Hughes in violation of Section 230.12.5.A.3 of the Charles County Animal Regulations and order her to comply with the requirements stated in Section 12.5.E.1, 2, 3, 5 (a) and (b) and 8 of the Charles County Animal Regulations.  A second was made and the vote passed unanimously. No fines were imposed.

 

There being no further business, the Chairman adjourned the hearing at 9:50 p.m.
