ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND

MINUTES OF MEETING - CASES

Tuesday, December 16, 2014

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES

 

The minutes of the Animal Matters Hearing Board for November 14, 2014, were approved and adopted.

 

            File No. 14-20 – The case of John Faherty against Greg Absher was called. The complainant, Mr. Faherty did not appear at the hearing, therefore this case was dismissed.

 

File No. 14-21 – The case of William Sigmon, Sr. against Greg Absher was called. Both parties were present at the hearing and not represented by counsel. Testimony was heard from William Sigmon Sr. and Greg Absher.

Based on the testimony heard, the Chairman made a motion to find Mr. Absher in violation of Section 12.4.A.6 of the Charles County Animal Regulations and that he obey all laws for 18 months. A second was made and the vote passed unanimously. No fines were imposed.

 

            File No. 14-22 – The case of James Martin against Mary Ullman was called. Both parties were present at the hearing and not represented by counsel. Testimony was heard from James Martin and Mary Ullman. Entered into evidence was a vet receipt marked Owner Ex. 1, and a five page report for spay and neuter from the Charles County Humane Society.

            Based on the testimony and evidence presented, Kristin Lake made a motion to find Ms. Ullman in violation of Section 12.4.A.1, Section 12.4.A.2, Section 12.4.A.7 and Section 12.4.A.8 of the Charles County Animal Regulations for her cats and not in violation of Section 12.5.A.2.and Section 12.5.C with a fine of $400.00, suspending $200.00 from that amount on the condition that Ms. Ullman come into compliance with Board’s Order by February 3, 2014. And obey all laws for 18 months. Ms. Ullman satisfied the balance of $200.00 at the end of the hearing.

 

            File No. 14-23 – The case of Danielle Kaloz against Walter and Nora Ott was called. The complainant Ms. Kaloz was not present at the hearing, therefore this case was dismissed.
 

            File No. 14-24 – The case of David Morningstar against Marcell Westney was called. Both parties were present at the hearing and not represented by counsel. Testimony was heard from David Morningstar, Marcell Westney and Pamela Westney.

            Based on the testimony heard, the Chairman made a motion to find Mr. and Mrs.  Westney in violation of Section 12.4.A.4 and Section 12.4.A.6 of the Charles County Animal Regulations for their dog “Nyla” and that they obey all laws for 18 months. A second was made and the vote passed unanimously. No fines were imposed.

 

            File No. 14-26 – The case of Kim and Steve Dye against Shannel Davis-Evans was called. The owner, Shanell Davis-Evans was not present at the hearing, and this case was referred to the State’s Attorney’s Office.

 

 

There being no further business, the Chairman adjourned the hearing at 8:45 p.m.            .
