MINUTES OF MEETING - CASES

Tuesday, October 7, 2014

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES

 

The minutes of the Animal Matters Hearing Board for September 16, 2014, were approved and adopted.

 

           

Citation No. 6371issued to Stephanie P. Brown, 11248 Hess Court, Waldorf, Maryland 20601 for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations for her dog “Blackie”. Ms. Brown was present at the hearing and not represented by counsel. Ms. Brown admitted to being in violation of all three violations.

The Chairman made a motion to find Ms. Brown in violation of all three violations and fine her a total of $250.00 and suspend $220.00 form that amount on the condition that she obey all laws for 18 months. A second was made and the vote passed unanimously.  Ms. Brown satisfied the balance of $30.00 at the end of the hearing.

 

Citation No. 6387 – issued to Clarence Jackson, Jr., 2246 Delight Court, Waldorf, Maryland 20601 for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations for his dog “Harry”. Mr. Jackson having failed to appear, and there being no request for a continuance, this case was referred to the State’s Attorney’s Office.

Citation Nos. 6271 and 6272 – issued to Deron Wells, 10335 Lorraine Drive, Newburg, Maryland for the alleged violation of Section 230.10.A and Section 230.12 of the Charles County Animal Regulations for his dogs “Bella” and “Drake”. Mr. Wells was present at the hearing and not represented by counsel. Mr. Wells admitted to being in violation of both allegations. Mr. Wells submitted a current license for both dogs marked AC Ex. 1.

The Chairman made a motion to find Mr. Wells in violation of both Sections of the Animal Regulations and fine him a total of $200.00 and suspend $140.00 from that amount on the condition that he obey all laws for 18 months. A second was made and the vote passed unanimously. The Board gave Mr. Wells until the close of business on October 21, 2014 to satisfy the balance of $60.00.

Citation No. 6274 – issued to Gary L. Bowie, 8235 Greenleak Hill Road, Nanjemoy, Maryland 20662 for the alleged violation of Section 230.10.A and Section 230.9.A for 18 chihuahuas. Mr. Bowie was present at the hearing and not represented by counsel. Mr. Bowie admitted to being in violation of both allegations. Mr. Bowie submitted 18 current animal licenses and rabies certificates.

The Chairman made a motion to find Mr. Bowie in violation of both Sections and fine him a total of $3450.00 and suspend $2,670.00 from that amount on the condition that he obey all laws for 18 months and that he have no more than 10 dogs at a time. A second was made and the vote passed unanimously.  The Board allowed Mr. Bowie until the close of business on February 3, 2015 to satisfy the balance of $780.00

Citation No. 6269 – issued to Gary L. Bowie, 8235 Greenleak Hill Road, Nanjemoy, Maryland 20662 for the alleged violation of Section 230.12.4.A.9 of the Charles County Animal Regulations. Mr. Bowie was present at the hearing and not represented by counsel. The Chairman made a motion to refer this case to the State’s Attorney’s Office. A second was made and the vote passed unanimously.

Citation No. 6361 – issued to Mark A. Watson, II, 6972 Heather Drive, Bryans Road, Maryland 20616 for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations. Joshua Briscoe was present at the hearing and without objection was substituted as the owner of “Brix”.  Mr.Briscoe admitted being in violations of all three allegations. The owner submitted a current rabies certificate and a current animal license, marked Owner Ex. 1.

The Chairman made a motion to find Mr. Briscoe in violation of all three Sections of the Animal Regulations and fine him a total of $250.0 and suspend $190.00 from that amount on the condition that he obey all laws for 18 months. A second was made and the vote passed unanimously. The Board allowed Mr. Briscoe until the close of business on October 21, 2014 to satisfy the balance of $60.00.

            Citation No. 6205 – issued to Jessica R. Mudd, 1019 Suffolk Drive, La Plata, Maryland 20646 for the alleged violation of Section 230.8 of the Charles County Animal Regulations for her dog “Moo”. Ms. Mudd was present at the hearing and not represented by counsel. Ms. Mudd admitted to being in violation of Section 230.8. Officer Gustafson addressed the Board and presented three photos marked AC Ex. 1.

            The Chairman made a motion to find Ms. Mudd in violation of Section 230.8 and fine her a total of $50.00 and suspend that amount on the condition she obey all laws for 18 months.

            Citation No. 6344 – issued to Lisa K. Snyder, 955 Massey Place, Nanjemoy, Maryland 20662 for the alleged violation of Section 230.6.B, Section 230.10.A, Section 230.9.B and Section 230.12.5 of the Charles County Animal Regulations. Ms. Snyder was present at the hearing and not represented by counsel. A hearing was requested. Testimony was heard from Officer Gustafson and Ms. Snyder. Testimony was also heard from Tracie Willett (witness for AC). Entered into evidence was a receipt for reclaim and boarding fees in the amount of $330.00 for Tri-County Animal Shelter if she reclaimed “Duce” the following day, a quarantine report marked AC Ex. 2. And ? photos marked AC Ex. 3.

            Based on the testimony and evidence presented, the Chairman made a motion to find Ms. Snyder in violation of all four Sections of the Animal Regulations and fine her a total $1,700 and suspend $1,010.00 from that amount. The Chairman’s motion also included Ms. Snyder to comply with Section 230.12.5.E (1), (2), (3), 5 (a and b), 6 and 8 of the Charles County Animal Regulations. A second was made and the vote passed unanimously. The Board requested an update regarding training and neutering of “Duce” on or before November 18, 2014. The Board gave Ms. Snyder until the close of business on February 3, 2015 to satisfy the balance of $690.00.

 

 

 

 

 

There being no further business, the Chairman adjourned the hearing at 9:00 p.m.            .
