FOR CHARLES COUNTY, MARYLAND

MINUTES OF MEETING - CASES

Tuesday, August 5, 2014

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES

 

The minutes of the Animal Matters Hearing Board for July 15, 2014, were approved and adopted.

 

            Citation No. 6203 – issued to Shelly R Smoot, 8065 Tempo Place, Pomfret, MD 20675 for the alleged violation of Section 230.9.A of the Charles County Animal Regulations. Ms. Smoot was present at the hearing and not represented by counsel. Testimony was heard from Officer Gustafson and Ms. Smoot. Ms. Smoot admitted to being in violation of Section 230.9 of the Charles County Animal Regulations. Entered into evidence was a current rabies certificate marked Owner Ex. 1.

Based on the testimony and evidence presented, the Vice Chairman made a motion to find Ms. Smoot in violation of Section 230.9.A of the Charles County Animal Regulations and fine her a total of $150.00 and suspend $130.00 from that amount. The Board allowed Ms. Smoot until the close of business on September 2, 2014 to satisfy the balance of $30.00.

            Citation Nos. 6382, 6383 and 6384 – issued to Osalee Gates, 4683 Gradwell Place, Waldorf, Maryland 20603 for the alleged violation of Section 230.10.A and Section 230.8 of the Charles County Animal Regulations. Mr. Gaines was not present at the hearing and and there being no request for a continuance, these cases were referred to the State’s Attorney’s Office.

                     Citation No. 6386 – issued to Heather Daugherty, 10600 Lofton Hill Place, La Plata, Maryland 20646 for the alleged violation of Section 230.10.A, Section 230.8 and Section 230.9.A of the Charles County Animal Regulations. Ms. Daugherty was present at the hearing and not represented by counsel. Ms. Daugherty admitted to being in violation of all three Sections of the Animal Regulations. Testimony was heard from Officer Alison Budd and Ms. Daugherty. Entered into evidence was a current rabies certificate marked Owner Ex. 1.

            Based on the testimony and evidence presented, the Vice Chair made a motion to find Ms. Daughtery in violation of Section 230.10.A and Section 230.8 and fine her a total of $350.00 and suspend $210.00 from that amount.  A second was made and the vote passed unanimously. The Board allowed Ms. Daugherty until the close of business on September 2, 2014 to satisfy the balance of $140.00.

            Citation No. 6368 - issued to Shannae M. Davis, 3002 H. Pilgrim Square, Waldorf, MD 20602 for the alleged violation of Section 230.8 of the Charles County Animal Regulations. Ms. Davis was present at the hearing and not represented by counsel. Ms. Davis admitted to being in violation of Section 230.8 of the Animal Regulations. Testimony was heard from Officer Budd and Ms. Davis.

            Based on the testimony heard, the Vice-Chair made a motion to find Ms. Davis in violation of Section 230.8 and fine her a total of $300.00 and suspend $200 from that amount. A second was made and the vote passed unanimously. The Board allowed Ms. Davis until the close of business on September 2, 2014 to satisfy the balance of $100.00.

            Citation No. 6369 – issued Jason Jones, 18855 Wicomico River Drive, Cobb Island, MD 20625 for the alleged violation of Section 230.10.A and Section 230.8 of the Charles County Animal Regulations. Mr. Jones was present at the hearing and not represented by counsel. Mr. Jones admitted to being in violation of both Sections of the Animal Control Regulations. Testimony was heard from Officer Budd and Mr. Jones. Entered into evidence was a current animal license marked Owner Ex. 1.

            Based on the testimony and evidence presented, the Vice Chair made a motion to find Mr. Jones in violation of Section 230.10.A and Section 230.8 of the Animal Regulations and fine him a total of $315.00 and suspend $200.00 from that amount, leaving a balance of $115.00. A second was made and the vote passed unanimously. The Board allowed Mr. Jones until the close of business on September 2, 2014 to satisfy the balance of $115.00.

            Citation No. 6369 – issued to Eric Vlloa, 101 Lancashire Court, LaPlata, MD 20646 for the alleged violation of Section 230.8 of the Charles County Animal Regulations. Mr. Vlloa was not present at the hearing, and there being no request for a continuance, this case was referred to the State’s Attorney’s Office.

            Citation No. 6273 – issued to Robert J. Centeno, 206 Blair Road, Indian Head, MD 20640 for alleged violation of Section 230.8 of the Charles County Animal Regulations. Mr. Centeno was not present at the hearing, and there being no request for a continuance, this case was referred to the State’s Attorney’s Office.

            Citation No. 6358 – issued to Cathy Staples, 8995 Bridgett Lane, La Plata, MD 20646, for the alleged violation of Section 230.12 and Section 230.12.5 of the Charles County Animal Regulations. Ms. Staples was present at the hearing and not represented by counsel. Ms. Staples entered a plea of not guilty and requested a hearing. Officer Thomas, who issued the citation  was present. However, Officer Thomas was not an eye witness to the incident. Officer Thomas subpoenaed a civilian witness, who failed to appear. The Board found Ms. Staples not in violation and advised her to obey all laws.

           

           

 

 

        

 

There being no further business, the Chairman adjourned the hearing at 9:30 p.m.
