ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND

MINUTES OF MEETING - CASES

Tuesday, July 1, 2014

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES

 

The minutes of the Animal Matters Hearing Board for June 17, 2014, were approved and adopted.

 

            Citation No. 6334 – issued to Kathleen A. Linderman, 615 University Drive, Waldorf, MD 20602 for the alleged violation of Section 230.10.C of the Charles County Animal Regulations. Ms. Linderman was present at the hearing and not represented by counsel. Testimony was heard from Officer Earle and Ms. Linderman. Ms. Linderman admitted to being in violation of Section 230.10.C. Entered into evidence was a current Animal Establishment License issued on June 3, 2014.

Based on the testimony and evidence presented, the Vice Chairman made a motion to find Ms. Linderman in violation of Section 230.10.C of the Charles County Animal Regulations and fine her a total of $$250.00 and suspend $200.00 from that amount on the condition she obey all laws for 18 months. The Board allowed Ms. Linderman until the close of business on July 15, 2014 to satisfy the balance of $50.00.

            Citation Nos. 6335– issued to Mario Entienne, 7040 Wood Glen Drive, Hughesville, MD 20637 for the alleged violation of Section 230.10.B, and Section 230.10.C of the Charles County Animal Regulations for his 25 dogs. Mr. Etienne was present at the hearing, and not represented by counsel. Testimony was head from Officer Earle and Mr. Etienne. Officer Earle withdrew the violation of Section 230.10.B and Mr. Etienne admitted to being in violation of Section 230.10.C. Mr. Etienne informed the Board that he is still working on getting a shelter for his dogs and applying for a permit from Planning and Growth Management.

            Based on the testimony and evidence presented, the Vice Chairman made a motion to find Mr. Etienne in violation and fine him a total of $250.00, none suspended and to apply for the zoning permit no later than August 30, 2014, and to keep in touch with Officer Earle as to the progress he is making. A second was made and the vote passed unanimously. The Board allowed Mr. Etienne until the close of business on September 2, 2014,

            Citation No. 6362 – issued to Stephanie M. Pickeral, 4108 Lancaster Circle, Waldorf, Maryland 20603 for the alleged violation of Section 230.8.A.(6)of the Charles County Animal Regulations. Mr. Gaines was present at the hearing and not represented by counsel. Mr. Gaines denied being in violation of Section 230.8.(6) for her dog “Mickey”. Testimony was heard from Officer Alison Budd and Ms. Pickeral. Entered into evidence was vet report marked AC Ex. 1, adoption papers issued to Ms. Pickeral, marked AC Ex. 2, and a report from Humane Society, marked AC Ex. 3. Also entered into evidence was a bottle of antibiotics for “Mickey”, marked Owner Ex. A.

            Based on the testimony and evidence presented, the Vice Chair made a motion to find Ms. Pickeral in violation and fine her a total of $1000.00 and suspend $500.00 from that amount, leaving a balance of $500.00 to be satisfied on or before August 19, 2014. The Board Ordered, without any objection from Ms. Pickeral that she not be allowed to adopt another dog from Tri-County Animal Shelter. A second was made and the vote passed unanimously.

                    Citation No. 6366 – issued to Devron E. Hatton, 2247 Westwood Drive, Waldorf, MD 20601 for the alleged violation of Section 230.10.A, Section 230.8.A. (6) and Section 230.9.A of the Charles County Animal Regulations. Mr. Hatton, having failed to appear, and there being no request for a continuance, a judgment in the amount of $1200.00 was made and this case was referred to the State’s Attorney’s Office.

           

           

 

 

 

           There being no further business, the Chairman adjourned the hearing at 9:00 p.m.            .
