FOR CHARLES COUNTY, MARYLAND

MINUTES OF MEETING - CASES

Tuesday, June 3, 2014

 

The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:30 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members.

 

APPROVAL OF MINUTES

 

The minutes of the Animal Matters Hearing Board for May 20, 2014, were approved and adopted.

 

            Citation No. 6363 and 6364 – issued to Leatrice Washington, Marbury, MD 20658 for the alleged violation of Section 230.10.A, and Section 230.8 for citation no.6363 plus Section 230.12 for Citation No. 6364 of the Charles County Animal Regulations for her dogs “Nitro” and “Diva.” Officer Budd withdrew the allegation of Section 230.12.5 for both citations. Ms. Washington was present at the hearing and not represented by counsel. Testimony was heard from Officer Budd and Ms. Washington. Ms. Washington admitted to all the alleged allegations in both citations. Testimony was also heard from James Johnson and Henry Lee (witnesses for AC). Officer Budd informed the Board that the two dogs had been relinquished to the County by Ms. Washington. Entered into evidence were 10 photos marked AC Ex. 1.

Based on the testimony and evidence presented, the Chairman made a motion to find Ms. Washington in violation of all the above Sections of the Charles County Regulations and fine her a total of $1200.00 for both citations and suspend $850.00 from that amount, leaving a balance of $350.00 to be paid on or before July 1, 2014 or the cases would be referred to the State’s Attorney’s Office. Ms. Washington paid a total of $150.00 at the end of the hearing.

           Citation Nos. 6336 and 6337– issued to Caleb A. Bailey, 5200 Christmas Place, Waldorf, MD 20601 for the alleged violation of Section 230.12, Section 230.12.5 and Section 230.12.6 C of the Charles County Animal Regulations for his dogs “Dakota” and “Shadow”. Mr. Bailey was present at the hearing, and not represented by counsel. Testimony was head from Officer Earle and Mr. Bailey. Mr. Bailey admitted to being in violation of Section 230.12 and Section 230.12.6 for both citations and not in violation of Section 230.12.5 for both citations. He informed the Board that he has fixed the invisible fence since the incident. Entered into evidence was one photo marked AC Ex. 1.

            Based on the testimony and evidence presented, the Chairman made a motion to find Mr. Bailey in violation of Section 230.12, Section 230.12.5 and Section 230.12.6 of the Animal Control Regulations and fine him a total of $260.00, to be paid on or before July 17, 2014. A second was made and the vote passed unanimously. The Board allowed Mr. Bailey to reclaim his dogs the following day on the condition that he satisfy the amount of $520.00 to Tri-County Animal Shelter for reclaim and boarding fees.

            Citation No. 6254 and 6255 – issued to Marcellus Gaines, 13 Jameson Court, Indian Head, Maryland 20640 for the alleged violation of Section 230.10.A, Section 230.12, Section 230.9.A and Section 230.12.5 of the Charles County Animal Regulations. Mr. Gaines was present at the hearing and not represented by counsel. Mr. Gaines admitted to being in violation of all the above Sections of the Charles County Animal Regulations for his dogs “Yogi” and “Honey”. Testimony was heard from Officer Jeff Thomas and Mr. Gaines. Mr. Gaines informed the Board that he would not be reclaiming his dogs from Tri-County Animal Shelter.

            Based on the testimony and evidence presented, the Vice Chair made a motion to find Mr. Gaines in violation of all the above Sections of the Animal Control Regulations and fine him a total of $1500.00 and suspend $990.00 from that amount, leaving a balance of $510.00 for both citations.  A second was made and the vote passed unanimously. The balance of $510.00 is to be satisfied on or before July 1, 2014 or the cases will be referred to the State’s Attorney’s Office.

           Citation No. 6268 – issued to Allen Rice, 805 Kirkwood Road, Waldorf, MD 20602 for the alleged violation of Section 230.12 and Section 230.12.5 (failure to comply with previous Boards Order) of the Charles County Animal Regulations for his dog “Junior”. Mr. Rice was present at the hearing and not represented by counsel. Testimony was heard from Officer Earle and Mr. Rice. Mr. Rice admitted to being in violation of both Sections of the Animal Regulations.

            Based on the testimony heard, the Chairman made a motion to find Mr. Rice in violation of Section 230.12 and Section 230.12.5 and fine him a total of $215.00 to be satisfied on or before July 1, 2014 and to abate the nuisance of his dog being at large for 18 months. A second was made and the vote passed unanimously.

            Citation No. 6262 – issued to Guy Latimer, 3785 Middletown Road, White Plains, MD 20695 for the alleged violation of Section 230.11 (animal care – shelter) for his goat “Nanny”. Mr. Latimer was present at the hearing and not represented by counsel. Mr. Latimer denied being in violation of Section 230.11. Testimony was heard from Officer Alison Budd and Mr. Latimer. Entered into evidence was one photo from March 25, 2013 and two photos from April 1, 2014 marked AC Ex. 1.

            Based on the testimony and evidence presented, the Chairman made a motion to find Mr. Latimer in violation and fine him $35.00 and suspend $20.00 from that amount on the condition that he obey all laws for 18 months. A second was made and the vote passed unanimously. The Board allowed Mr. Latimer until July 1, 2014 to satisfy the balance of $15.00.

            Citation Nos. 6356 and 6357 – issued to John Keys, Jr., 7460 Simms Landing Road, Port Tobacco, MD 20677 for the alleged violation of Section 230.10.A for both citations and Section 230.9.A for Citation No. 6357. Mr. Keys was present at the hearing and not represented by counsel. Testimony was heard from Officer Thomas and Mr. Keys. Mr. Keys admitted to being in violation for both alleged violations for both citations.

            Based on the testimony heard the Chairman made a motion to continue these two cases until the next scheduled hearing on July 1, 2014 to allow Mr. Keys time to obtain a current animal license and a current rabies certificate and present them to the Board at that time. A second was made and the vote passed unanimously.

            Citation No. 6243 – issued to Lexus T. Brooks, 4203 Drake Court, Waldorf, MD 20603, for the alleged violation of Section 230.10.A, Section 230.12 and Section 230.9.A of the Charles County Animal Regulations for her dog “Stretch”.  Latoyta Barnes (mother) was present at the hearing, and without objection, was substituted as the owner of “Stretch”. Ms. Barnes relinquished ownership of “Stretch” to the County.

            Based on the testimony heard, the Chairman made a motion to find Ms. Brooks in violation of all three Sections and fine her a total of $250.00, with $110.00 suspended, leaving a balance of $140.00 to be satisfied on or before July 1, 2014 or the case would be referred to the State’s Attorney’s Office.

            Citation No. 6244 and 6245 – issued to Marcus A. Allen, 2777 Hadley Drive, Waldorf, MD 20601 for the alleged violation of Section 230.10.A, Section 230.8 and Section 230.9.A of the Charles County Animal Regulations for his dogs, “Chaos” and “Mia”. Mr. Allen was present at the hearing and not represented by counsel. Testimony was heard from Officer Budd and Mr. Allen. Entered into evidence were two photos marked AC Ex. 1 and six pages of photos marked Owner Ex. A. Mr. Allen advised the Board that his two dogs are being housed at Tri-County Animal Shelter since his house burnt down and will be kept there until he can find a suitable home for them to come back.

            Based on the testimony and evidence presented, the Chairman made a motion to find Mr. Allen in violation of Section 230.10.A, Section 230.8 and Section 230.9.A and fine him a total of $500.00 and suspend $380.00 from that amount, leaving a balance of $120.00 which is due on or before July 15, 2014.

Citation Nos. 6352, 6353, 6354 and 6355 – issued to Diane F. Janes, 8650 Billingsley Road, White Plains, MD 20695 for the alleged violation of Section 230.10.A and Section 230.9.A of the Charles County Animal Regulations for her cat (unknown name), a cat named “Smokey” and also known as “Blue”, a cat named “Mike” and a collie type dog known as “Si”. Ms. Janes was present at the hearing, and not represented by counsel. Testimony was heard from Officer Thomas and Ms. James. She denied being in violation of Citation No. 6352, stating she was not the owner of that cat.

Based on the testimony heard, Kristin Lake made a motion to find Ms. Janes in violation for all four citations and fine her a total of $130.00 for each citation. The amount of $520.00 is to be satisfied on or before August 5, 2014 or the cases will be referred to the State’s Attorney’s Office.

           

 

           

                       

There being no further business, the Chairman adjourned the hearing at 9:30 p.m.            .
