OTHERS PRESENT: Rhonda Weaver, County Attorney, Counsel to the Commission, Melody Weschler, Clerk to the Commission.
CALL TO ORDER FOR SESSION:
The meeting was called to order by Chairman Buehler at 6:01 p.m.
A motion was made by Mr. Fitzgerald to approve the January 24, 2018 open meeting minutes, seconded by Mr. Collins, unanimously carried.
The Commission reviewed the 2017 Financial Disclosure Forms from A. Stewart and P. Murphy. Ms. Weaver explained that the County Attorney’s Office received a request for financial disclosure forms for these individuals and they will be released.
Financial Disclosure Forms for 2018 – Ms. Weaver discussed with the Commission an additional to next year’s form to include the question, has your home address changed since you last completed this form? Ms. Weaver explained that this will assist in determining if a person assigned to a board or commission has changed districts that they are representing. Mr. Purnell made a motion to adopt the revision to the form for next year, seconded by Mr. Collins, unanimously carried.
Advisory Opinion 2018-01 – The Ethics Commission received a referral from the County Attorney’s Office for an advisory opinion. The question to the County Attorney’s Office was as follows: whether or not a Charles County employee can serve on the Charles County Democratic Central Committee and if so, would there be a conflict of interest with the Federal Hatch Act?
Ms. Weaver provided background information and pertinent County Code needed by the Commission to provide an advisory opinion. The Commission discussed the information and the draft advisory opinion and made changes to the opinion. Ms. Weaver made the appropriate changes as requested by the Commission. Mr. Fitzgerald made a motion to approve the Advisory Opinion as submitted with the changes as noted by the Board, seconded by Mr. Collins, unanimously carried. All Board members in attendance signed Advisory Opinion 2018-01.
Open Meetings Training – Ms. Weaver encouraged all members to do the Open Meetings training online and send Ms. Weschler a copy of the certificate.
A motion was made by Mr. Purnell to go into closed session to discuss the closed meeting minutes of May 31, 2017, seconded by Mr. Fitzgerald, unanimously carried. The Commission went into closed session at 6:56 p.m. in accordance with General Provisions Article §3-305(b) to discuss: (1) The appointment, employment, assignment, promotion, discipline, demotion, compensation, removal, resignation, or performance evaluation of appointees, employees, or officials over whom this public body has jurisdiction; or any other personnel matter that affects one or more specific individuals.
At 7:10 p.m. a motion was made by Mr. Purnell to go back into open session, seconded by Mr. Fitzgerald, unanimously carried.
Rev. Buehler advised the Commission of the appointment of a new member to take the spot vacated by Mr. Purnell.
Rev. Buehler, on behalf of the Ethics Commission, thanked Mr. Purnell for his service to the Commission.
ADJOURNMENT: With no further business Mr. Fitzgerald made motion to adjourn the meeting at 7:11 p.m., seconded by Mr. Purnell, all in favor.
