The regularly scheduled meeting of the Animal Control Board for Charles County, Maryland, was convened by the Chairman at 6:00 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members in attendance.

A quorum was declared based upon the presence of a majority of the appointed Board Members;



The minutes of the Animal Matters Hearing Board for February 19, 2019 were approved and adopted.

            File No. 19-05 – The case of Emily A. Swann against Oscar Zelaya was called. Both parties were present at the hearing. Testimony was heard from Ms. Swan, Mr. John Duker (witness for the complainant) and Mr. Zelaya. Ms. Swann testified that while at the dog park, Mr. Zelaya’s dog attacked her dog and attempted to attack her when she tried to remove his dog from hers. Entered into evidence were 2 photos marked Exhibit 1 and a vet report entered as Exhibit 2. Mr. Zelaya testified that his dog gets along with other dogs as well as children and suspects that something happened to cause his dog to snap the way she did towards Ms. Swann’s dog.                                  

A motion was made to find Mr. Zelaya in violation of Section 12.5.A.2 and Section 12.5.C (Potentially Dangerous) of the Charles County Animal Regulations with a fine of $250.00 and ordered that Mr. Zelaya abate the nuisance of 230.12.5.E (1), (2), (3), (4), (5A), (5B), (5C), and 8(G). The motion was seconded and passed with all members voting in favor. The vote to support the motion passed. Mr. Zelaya satisfied the fine at the hearing.


            File No. 19-06 – The case of Andre Bolden and Michael Edelen against Maria Ramirez. Ms. Ramirez was present. The complainants were not present. There was a motion to dismiss the case due to the absence of the complainants. The motion was seconded and passed with all members voting in favor to dismiss the case. The case was dismissed.


Other Business

Clerk to the Board, Ms. Team notified the board that on September 18, 2018, the case of Barbara Adams was brought before the Animal Matters Hearing Board for receiving a citation (#6841) for alleged violation of Section 230.10.C of the Charles County Animal Regulations. Ms. Adams did not appear before the Board, but she paid the violation in the amount of $250.00 the day before the hearing. During the hearing there was a motion to order Ms. Adams to downsize to three animals or obtain a fancier’s license and discontinue selling the dogs and included a fine of $450 including a $200 fine for failure to appear. Ms. Adams was not required to come to the hearing. Therefore, there was a motion to amend the motion for citation 6841 to remove the $200 fine for failure to appear. The motion was second and passed with all members voting in favor.


There being no further business, the Chairman adjourned the hearing at 7:00 p.m.
