ANIMAL MATTERS HEARING BOARD

FOR CHARLES COUNTY, MARYLAND MINUTES OF MEETING

Tuesday, September 17, 2019

A meeting of the Animal Matters Hearing Board for Charles County, Maryland, was convened by the Vice Chairperson at 6:35 p.m. in the County Commissioners Meeting Room, Charles County Government Building, with the following Board members.

Sgt. Travis Yates

Bill Van Blarcum

Christi Montgomery

Shanee’ Major-Kelly, Associate County Attorney

Melody Weschler, Acting Clerk

Samantha Knott, Paralegal

A quorum was declared based upon the presence of a majority of the appointed Board Members.

New Business

Citation 6740 – Animal Control versus Jorge Enriquez

Mr. Enriquez did not show for the hearing.

Officer Heiss testified that on August 5, 2019 she responded to a call of a K-9 at large. The K-9 was caught and impounded at the Tri-County Animal Shelter.  A citation was issued on August 6, 2019. 

A motion was made by Ms. Montgomery finding Mr. Enriquez in violation of:

Section 230-10.A for a fine of $50.00

Section 230-12 for a fine of $100.00 (second offense)

Section 230-9.1 for a fine of $150.00,

with a total fine of $300.00

And that the order be forwarded to the State’s Attorney’s Office if not paid by October 15, 2019, seconded by Sgt. Yates, all in favor.

 

Citation 6840 – Animal Control versus Brandon Robbs

Mr. Robbs did not show for the hearing.

Officer Thomas testified that on August 12, 2019 he responded to a call of a K-9 left inside a vehicle.  Upon arrival at the scene Officer Thomas found a K-9 dead in the vehicle.  Officer Thomas responded that the air temperature inside the vehicle was between 117 and 126 degrees.   The back window of the vehicle was open and the vehicle was parked in front of a residence.  Officer Thomas testified that Mr. Robbs arrived about 20 minutes after he arrived.  Mr. Robbs stated he had placed the K-9 in the vehicle. County’s exhibit 1 of 13 pictures were admitted into evidence.

A motion was made by Ms. Montgomery finding Mr. Robbs in violation of section 230-8.A, Animal Cruelty, with a fine of $1,000, and the order be forwarded to the State’s Attorney’s Office if not paid by October 15, 2019, seconded by Sgt. Yates, all in favor. 

 

Citation 6791 – Animal Control vs. Brettanna M. Weathers

Officer Gustafson advised the Board that Ms. Weathers advised that the K-9 belonged to her son Joseph Lemons.  Officer Gustafson and Ms. Weathers was sworn by the Clerk.  Ms. Weathers stated that the K-9 belonged to her son, Joseph Lemons.  Mr. Lemons was sworn by the Clerk.

Officer Gustafson testified that on August 28, 2019, he responded to a call of two K-9s chasing a person.  Officer Gustafson testified that upon arrival he found two K-9s running at large.  A citation was issued.

Mr. Lemons testified that he has a current rabies license and a current Charles County License and provided  

A motion was made by Sgt. Yates finding Mr. Lemons in violation of:

Section 230.10.A with no fine

Section 230-12 with a fine of $25.00

Section 230-9.A with no fine,

with a total fine of $25.00.

Seconded by Mr. Van Blarcum, all in favor. 

Mr. Lemons said he could pay the fine by next Friday, September 27, 2019.

 

Citation 6792 – Animal Control vs. Trea Lemons

Officer Gustafson testified that on August 28, 2019, he responded to a call of  K-9s chasing a person.  Officer Gustafson testified that upon arrival he found two K-9s running at large.  A citation was issued.

Mr. Lemons testified that he has a current rabies license and a current Charles County License and provided  

A motion was made by Sgt. Yates finding Mr. Lemons in violation of:

Section 230.10.A with no fine

Section 230-12 with a fine of $25.00

Section 230-9.A with no fine

with a total fine of $25.00

Seconded by Ms. Montgomery, all in favor. 

Mr. Lemons said he could pay the fine by next Friday, September 27, 2019.

 

Citation 6875 – Animal Control vs. Christopher Feaster

This matter was rescheduled to October 15, 2019 due to Mr. Feaster not being notified of the hearing date.

 

File No. 19-29 Leonard Smith vs. Scott Croughan

Mr. Smith and Mr. Croughan were sworn by the Clerk.

Mr. Smith testified that on June 29, 2019 he and his wife while putting his daughter’s two dogs into their car when they were attacked by Mr. Croughan’s two dogs. During the attack Mr. Smith was bitten and his daughter’s two dogs were injured. 

Mr. Croughan testified that on June 29, 2019 he was leaving his backyard and the two dogs rushed past him and got out.  He testified that the two dogs were rushing to say hi not attack and Mr. Smith reacted the wrong way.  He also stated that his one dog came right back and he put her back into the yard.  The second dog retreated but then one of Mr. Smith’s daughter’s dog came after his dog.  Mr. Croughan informed the Board that he took his dogs to the vet to have a third party determine if his dogs were aggressive and they were determined not to be aggressive.  He also informed the Board that the HOA rep came to the house to interview the dogs and did not find them aggressive.  Mr. Croughan moved into evidence Owner exhibit number 1, the Evaluation completed by the Vet. Mr. Croughan offered to pay all of Mr. Smith’s bills relating to the incident.    

Sgt. Yates made a motion finding Mr. Croughan in violation of:

Section 12.1.A(3) with a fine of $25.00

Section 12.4.A(4) with a fine of $25.00

With a total fine of $50.00.

Sgt. Yates did not find Mr. Croughan in violation of:

Section 12.4.A(1)

Section 12.4.A(2)

Section 12.4.A(6)

Section 12.5.A(1)

Section 12.5.A(2)

Section 12.5.A(3)

Section 12.C

Seconded by Ms. Montgomery, all in favor.

Mr. Croughan advised he would pay the fine on or before September 27, 2019. 

 

File No. 19-16 – Debra McKera vs. Alaina & Jim Bob Hess

Ms. McKera withdrew her complaint.

 

Administrative Appeal of Jasmine Adams, C-08-CV-19-000467

The Board advised Ms. Adams that they are postponing hearing her request regarding releasing her to a trainer until October 1 so that the trainer can be at the hearing.  Ms. Adams was agreeable to postponing to the October 1 meeting.

 

Other Business

Chief Tucker reported that regarding citation 6877 to Tiffany Wedding, the dog, Brownie, had been spaded on September 13, 2019 as ordered.

 

There being no further business Sgt Yates made a motion to adjourn the hearing, seconded by Ms. Montgomery. All members voted in favor and the hearing was adjourned at 7:55 p.m.
